Shipping Container Spot – Terms and Conditions

Welcome to Shipping Container Spot. This website, located at https://shippingcontainerspot.com/ (the “Site”), is owned and operated by Shipping Container Spot. Throughout the site, the terms “we”, “us” and “our” refer to Shipping Container Spot.

By visiting our site and/or purchasing a shipping container from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms, conditions, and policies referenced herein or available by hyperlink. Please read these Terms carefully before accessing or using our website.

1. Electronic Commerce & Site Eligibility

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction. A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. Accuracy of Pricing and Product Specifications

  • Pricing: All prices displayed on our website are in U.S. Dollars (USD). We reserve the right to modify prices for our shipping containers at any time without prior notice. However, once an order is placed and payment is authorized, the price for that transaction is locked.
  • Product Condition: We sell new (one-trip) and used shipping containers in various industry-standard grades (e.g., Cargo Worthy, Wind & Watertight, As-Is). Images on our website are representative examples of the grades described. Because used containers possess unique wear, rust, dings, and patch histories, the cosmetic appearance of your delivered container may vary slightly from online gallery images while still strictly adhering to the ordered structural grade specifications.

3. Payment Terms & Billing Information

We reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. If a fraudulent payment, unauthorized chargeback, or billing discrepancy occurs, we reserve the right to halt processing, cancel the order, and recover the equipment at the buyer’s expense.

4. Shipping, Logistics, & Site Liability Disclaimer

Our Shipping Policy governs the dispatch and transport of all structural cargo equipment. By purchasing a container, you explicitly agree to the following logistics constraints:

  • The Buyer’s Ground Responsibility: Shipping Container Spot and its third-party freight carriers are not liable for any property damage (including but not limited to broken driveways, cracked concrete, damaged lawns, underground utility lines, or low clearance structures) resulting from a delivery driver attempting to drop a container on an inadequately prepared site or following the explicit placement directions of the buyer.
  • Failed Delivery Costs: If a delivery truck is turned away due to unsafe ground conditions or lack of adequate spatial clearance, the transaction will be treated as a return under the terms of our Refund and Return Policy, and round-trip transport fees plus restocking fees will apply.

5. Transfer of Title and Risk of Loss

The legal title of ownership and the risk of physical loss or damage to the shipping container passes completely to the buyer the moment the container is successfully offloaded from the transport trailer onto the buyer’s designated delivery site and the delivery receipt or Bill of Lading (BOL) is signed.

6. Modifications to the Service and Prices

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

7. Limitation of Liability

In no case shall Shipping Container Spot, our directors, officers, employees, affiliates, agents, contractors, or interns be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the services or any products procured using the service.

8. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by, interpreted, and enforced in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any legal actions or disputes arising out of these Terms must be filed in a state or federal court located in Hillsborough County, Florida.

9. Changes to Terms and Conditions

You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
